Role of Information Technology in dispensation of Justice

Truth, Justice and Bliss are the basic and fundamental nature of every human being and the social order. Illegality, injustice and disharmony are choice-less evils that continue to come into existence in the individual and the society. Judges, Advocates and others associated with them, continue to work as kidneys of the system, to detox the society. Conflicts, clashes and litigation have continued, since human civilization came into existence. Contract was created when Shri Ram hugged Sugreev and Vibheeshan and promised them to be made the king of Kishkindha and Sri Lanka respectively. A breach would have led to litigation and during that time resolved by the power of sword, than the power of pen. Justice was done when Shri Ram executed Raavan, for he had brought about a total imbalance in the economic structure, by amassing almost the entire gold existing on earth. Legal relationships, laws, litigation and justice existed even when Information Technology was not existing and was than more effective, efficient and economical.

In this yug, the age of IT started in 1955 when the number of white collar employees surpassed the blue collar, in USA and Europe. When I joined the profession in 1976 in Supreme Court, the settlement of weekly cause list was carried out by the Registrar at 4:30 pm on every Thursday in the Chief Justice Court. I had inherited AIR from 1914 onwards, had purchased SCR, Supreme Court Encyclopedia by Gopala Krishnan provided nominal Table Index, Basu and Mullah were the authenticated Text Books and Manuals were the source of finding the precedents. The only way to remain updated and to refrain from cutting a sorry figure and look around when the judge said “have you looked into the latest judgment delivered by us”, was to go through the cyclostyled judgments circulated by SCBA and regularly maintain personal registers.  As juniors, we had to run from court to court and shake shoulders of our colleague to find out, which matter was going on in the court and go back and tell our senior that he need to rush or need not rush to that court. Sometimes the matter was already over by the time he could reach. The bare acts were barely available.

Today all that looks ancient, we get bookmarked cause list on our mobiles, judgments can be found on tablets and electronic display system helps us to watch other court even when we are on our legs in the court room. Statutes are available within hours of their receiving the assent of the President. But the judges are overburdened by number of briefs and judgments and are at times conscious about the mounting arrears while disposing the cases. The judges have to read much more today, to have a total portrait of the true facts, keep their head high and impart justice without compromising with their conscience, than their predecessors and one basic reason for that, is explosion of information all around in multiple formats.

Three things are basic, fundamental and vital in every litigation and must never be lost sight off.
First, nobody loves advocates. Nobody would enter the office of an advocate unless he is in real trouble, unless his shoe is pinching and the nail is not decipherable and professional legal help is required to resolve the issue and put life in order. There comes the role of the advocates.
Second, every law or litigation comes into existence because there is suppression of a will, exploitation of a being by another and the cry has gone unheard because of some person dominating the existing social forces, by inhuman means. There comes the role of the Judges.
Third, all judges at all times, sitting in the temple of justice, see the cause and also see the persons and issues behind the cause and also the direction in which the society is moving and make all out efforts to do complete justice between the parties. That is how and why truth and justice exist and we still have a hope.

The litmus test of evolution and eminence of every institution today and hereafter will be the extant of use of information technology made by its stake holders.  It is not difficult to fully understand, appreciate and implement the extant of use of IT in dispensation of justice, as there is no rocket science involved in it. The difficulty is in making the stakeholders’ use it in every field of their activities. Use of IT in courts by NIC will not alone be effective unless, advocates and their clerks are well trained and tuned to use it.

Use of IT is a great bounty in the hands of us all, as it can be effectively used for collating, organizing and interlinking information. But a few things are imperative and if we do not pursue them, IT will be there but not as handmade to justice, but as money spinner for IT Consultants, hardware manufacturers and others and a fashion statement by flashing light on our own face and saying ‘Look! We also use IT”. We have to have a correct complete and overall picture of the entire litigating process, with the role of each stake holder well defined and the most important is the economics of each stakeholder. Every stakeholder in the legal industry is not working as an NGO, using tax payers money as grants or charities, but we are all here as professionals who are paid for speaking the truth and we demand respect and reverence, for we hold self - esteem, dignity and pride, in what we do. Finally we have to watch the vested interest of those who survive on chaos, confusion and commotion and those who are supporting them consciously, unconsciously or even remotely, for their interest is to lead the institution to legal rigor mortis and disgrace.

Look around and see if over 300 existing vacancies of judges in High Courts are not filled, because the issue is referred to a constitutional bench or otherwise, if cases are not determined speedily, if justice is not imparted in time, who is empowered. The answer is obvious, all those elements, whose very existence is based on presence of injustice, exploitation and poverty in the society and they are everywhere, from politics to beggars. Social predators continue to wait for assignment of throwing out tenants, recovery of created and illegal debts, holdings bandhs and gherao, shouting slogans, stalling court proceedings, making government fall and making the great nation look mean and small and IT makes such information available, easier and faster.

The installation of electronic display devices in 1986 in Supreme Court giving court number and item number was the first step in making use of IT and today we can get live display boards of all the courts on our mobile is a long leap, but that took more than 25 years. From getting judgments of courts on the tablets in a structured format to the ultimate, introduction of Artificial Intelligence in litigation is a long way to go and will take another 25 years or more, if we start today. Some of the countries are already using Artificial Intelligence for last over a decade in sentencing policy and other areas.

 IT can be implemented for dispensing justice by moving information seamlessly in the following manner with ease, if there is a Will to do it:

• Providing Neutral Citation for all judgments delivered by Supreme Court and 24 High Courts, to eliminate the chaos created by over 600 law reports published all over the country and now web judgments. All giving their own independent citations. Neutral Citation was implemented in Canada, UK, USA and Canada in year 2000, we are just 15 years behind
•  Creating database of judgments on each subject and issues and linking them with the subject index used in the court for classification of cases and making the data available to Advocates. This will bring more uniformity in decision making process and assist Advocates to give meaningful legal opinion to their clients;
• Entering DIN Number, PAN Number, Adhaar Card No. or any other identifiable number of each litigant, witness, deponent in each litigation and have a common linked database on litigating persons and those associated with them. We have over three crore pending cases and if we are able to create the interlinking database, believe you, me friends, we will be able to filter about thirty lakh professional criminals and professional litigants
• Creating a common database of litigation in which Government or any Article 12 Authority is a party and sharing it between Courts, Government Department, PSU, Law Department, Attorney General and Advocate General Office to enable legislature to plug holes where necessary and put an end to several frivolous litigations and putting them on notice in similar issues
• Existing data on decided cases should be moved from High Court Registry to Supreme Court Registry in cases filed in Supreme Court. This will save enormous costs and man hours of the country;
• Creating and using database on advocates on number and nature of filings, appearances, written submissions, articles published, presentations made, conferences attended to have some objective basis for appointment of advocates as judges to High Courts. Family, chamber, caste relationship is an anathema for holding such high station and injustice to other advocates joining the bar;
• Implementation of One Bar one Vote for each Bar Association by using a common data base of advocates already available with Bar Council of India and having electronic voting. This will make the Associations more effective, meaningful and purposeful. Every leader of the bar will have his defined territories to work on and make them more professional;
• There is a need of over two million IT trained clerks or Para Legal Associates to support over one million advocates in the country and maintain their office;
• Creating database on judgments delivered by judges of High Courts and how they fared in Supreme Court, to have some objective basis for appointment of High Court judges to Supreme Court;
• Implementing Court Live to bring about more transparency and fully implement the avowed principle of open door justice;

 In every case the Judge is on a chess board making whole hearted efforts to make justice win. On the other side is injustice continuously digging pits, confusing issues, flashing baits, veiling the truth, creating non-existent fears to make justice lose. Information technology if used to its full proper potential, is one of the greatest tool in the hand of judge, to make quick moves in dispensation of speedy justice. But to make its full use, judges will have to get all the stake holders trained and aware of interconnected, interlinked, inter-weaved and interlaced databases on judgments, statutes, subjects, issues, decisions, litigants, books, articles and a process that filter the entire information and also suggest possible, probable answers and alternatives, to enable the judges impart justice for all.

Sixty years of Lateral Existence

        Flashes continue to occur and re-occur from the first when as a 3 yrs. old child (1958) my mother, grandfather, another person and I got down from a brown Ford Prefect and walked to Jaipur Central Jail carrying breakfast for my father and his colleagues at the bar, who were detained for protesting against the abolition of High Court Bench at Jaipur. Justice K.N. Wanchoo, the than Chief Justice of Rajasthan had some perceptions and agenda to settle and that had led to the abolition of the Jaipur Bench. The next flash is getting down at Rai-ka-bagh Railway Station at Jodhpur with bag and baggage, as my father than an advocate in the High Court, had to shift with the family leaving the parental house at Jaipur to his Highness Flats opposite zoo. 57 years thereafter are flashes of a wonderful and incredible break at a beach resort in Kerala and the release of ‘Supreme Court on Arbitration and Contract’ last evening, January 9, 2015 at Indian Law Institute.

As I had continued to observe my paternal grandfather, Rao Bahadur Madho Prasad Gupta, in whose company I spend my childhood, enquiring into beyond and leading an extremely disciplined life far away from the mundane and the ephemeral and hear all the stories and read all the books, it dawned that realization of the Self is the true and ultimate goal of the existence. It also emerged that it was imperative that all events shall continue to come into existence and give way to the new, the very next moment, with the sole objective of making one consciously aware of the truth, that bliss was the nature of the Self and the Cosmic divine and that is beyond lateral time.

As I continued to observe my maternal grandfather, Dr. A.C. Bansal, a highly respected socialite at Agra, with a life full of spirit and freedom, a strong wish had evolved to serve the fellow beings by joining the medical profession, which continued to consciously and unconsciously dominate the core system till one day it became apparent that there existed an interplay of forces in chartering the life events as they would continue to arise according to their own mandate and I surrendered to them.

On August 1, 1976 I found myself in the corridors of Supreme Court of India and the most powerful intellectuals that existed in the nation. I continued to relentlessly contribute my very best for next 27 years to the profession and evolved with every case and social issue I dealt with, as a better human being in search of truth and justice. It continued to bring about understanding of the nuances of social, economic and political fabric and structuring, being constantly stitched and un-stitched. A feeling continued to air around that it will be possible to follow the footsteps of my father Justice D.P. Gupta, who retired as Chief Justice of High Court of Rajasthan, with the highest integrity, honesty, uprightness and honor. 12 years further, windows have continued to close and open again and again, beings have continued to walk in and walk out and walk in again, events have continued to come into existence and dissolve by its very nature to give way to the new.

Sixty years of lateral existence has not made me wiser to determine in the true sense, the little personal requirements and the grand social status, the deep inner peace and the magnificent collective recognition, the calm deep unchanging vibes and the charged public passions. There has been a constant awareness of the divine cosmic energy existing blissfully within unaffected by the constant movement of fleeting events all around. This awareness of the twin existence has continued to co-exist simultaneously in a quantum way every moment of my existence, for quite some time now. All exists here and now every moment. There is constant awareness of energies which have continued to exploit and damage the peace and harmony within and around, but there is also perception of divine cosmic energy and light workers relentlessly working to establish peace, love and eradicate poverty. The real contribution seems to be to create powerful legal structures to resolve some of the conflicts or open the conflicts by exposing their true nature, to be resolved in times to come, for a better tomorrow… 

Introductory Address on the Release of ‘The Origins of Astronomy, the Calendar & Time’ by Shri Kosla Vepa

I am just a nameless comet amongst the galaxy of stars and planets present here on the occasion of two days International Seminar on ‘Determining Cultural Continuity since Vedic and Epic Eras: Through sequential Dating of Astronomical References and other Corroborating Scientific Evidences’.

I think I met Kosla Vepa Ji for I had realized early in my profession that the process of proof in law, astronomy, mathematics, science and all knowledge based on logical deductions is the same and we could discuss issues in common. As lawyers we have to establish our client’s right and we search through facts and evidence in pages after pages to establish the truth and reach to justice by interpretation of words. Proof is conclusion reached by interpretation of words to reach the objective sought to be achieved. True interpretation is impossible when the language is foreign and the objective is to rule the race and that is why all work done on Indic civilization during the British Raj needs serious re-construction.

We are all here to establish the true facts about Indian kaalgadna from the first Manu to the seventh and then specifically from Dwapar Yug onwards and fit the events into them correctly so that we get our due respect if not the Intellectual Property Right. Friends, believe you me, it is only a matter of time, before the Truth triumphs. But in all what we are doing, we are in search of Satt Chitt Anand. Consciously aware of truth and enjoy the bliss of our doing. We are looking for a Gross Personal Happiness.

When I met Kosla Ji for the first time almost 10 yrs. ago I was awe struck by his passion to know and make available the true history of the Indic civilization which has been distorted by a group of persons which effort is still in vogue, some out of ignorance, some out of ego and others intentionally to demean, debase and exploit the greatest existing culture in the world. ‘The Origins of Astronomy, the Calendar And Time’ is an extra ordinary book by an extraordinary man in search of his Gross Personal Happiness.

The book is a result of a very hard labour and deep research by Kosla Ji who is now a name to be followed both in the western and eastern world of astronomy and Indic studies. Deep research, analysis of Kosla Ji in contemporary world is just remarkable and unparallel. The Appendix G Primary and other sources in Astronomy at p. 500, Appendix H Select Bibliography at p.514,  the list of General Interest Books on India and History of India at p. 516, Resources for Sanskrit Manuscripts in India at p. 518 and outside India at 530 and endnotes at p.579 depicts the degree of massive and extensive readings and research undertaken by Kosla ji.

The Comparative Timeline of Greece, south and West Asia at p. 533 and timeline of Significant Events in Trigonometry, Islamic Savants and Impact on Transmission at p. 247 are outcome of humongous research. Sanskrit Alphabets and Pronunciation at p.454 was a must must for quite some time as the destruction of any culture starts with destruction of its alphabets. From Om as the 0 and 64 alphabets Devnagri Lipi has lost its alphabets, some put it as 54 others as 58, courtesy those who have dominated the printing world for over 200 years now.

Last but not the least, the Global Perspective on Calendars at p.296 is another great phenomenal work. Bal Gangadhar Tilak in his book ‘Vedic Chronology and Vedanga Jyotisha’ in 1925 had emphasised and brilliantly put the system of Vedic Chronomlogy.  

Friends I am certain that Mr. Kosla Vepa will long be remembered as the true son of Maa Bharati for his contribution to Indic studies... On a personal note I must say that a major contribution to book comes from the silent and ever smiling Mrs. Vepa, standing strongly behind him.

Welcome Address and Introduction on release of 'Shrimat Bhagwad Geeta - The Song Celestial' at IIC on 24.01.2014 by Justice A.K.Patnaik

While invoking the divine energy that continue to exist within and all around us, I welcome you all here on this cold Delhi evening. I believe that the energy of our own awakening ignited by the presence and expressions by the profound speakers here will keep us warm and enlightened. I am overwhelmed by the presence of you all and I am certain that this will be one of the most memorable evenings for us all and we will all certainly cherish it for times to come. We will cherish this evening for we all will have the privilege of hearing the greatest existing minds in the country, expressing themselves on a subject which they have in fact lived with the highest integrity, while searching and imparting truth and justice to the fellow human beings. It is very difficult to say why they are great, but everyone who comes in touch with them has been touched by a spark of reality which is way beyond physicality. They have continued to hold themselves and carry on their profession with remarkable ease, joy and an eternal bliss as they continue to exist amongst us. Each one of them has a varied background, experience and approach but all of them have one thing in common, they have and are serving truth and justice with the highest possible integrity and have manifested a consciousness all through their legal and judicial career without fear and favor, with a zeal, magnanimity and fervor to impart justice and that comes only to few. They are clearly personification of the men of steadfast wisdom, steeped in samadhi. Ladies and gentlemen let us all spend this evening with the divine energy that moves the cosmos, the nation, the institutions and us all through karm yogies sitting with us… who will enlighten us all today. I welcome all the dignitaries on the dais and all my colleagues and friends to enjoy the divinity all around.

We all have moved in our life from mother’s love and grandfather’s story to telling stories. In our education we moved from grade to grade. We got into sports and enjoyed the team spirit. We got myriad information and developed knowledge and wisdom and continued to move towards professional excellence. We focused on material wealth, physical fitness, emotional maturity as a prerequisite for embarking on our journey of discovery to unknown, which unfolds every other moment. Social status, respect from fellow beings, political connection and visibility also followed. To keep fit we continued to undertake morning walk, perform yog, pranayam and meditation.

But all through the process we continued to be aware of our spiritual existence and growth, we have always been aware of the existence of a quiet mind and a deep consciousness within, which allowed us keen observance of the road ahead and evaluate the options available for renewal of life energy within. We continued to crave to do what we always wished to do in life and that is the final freedom of action in true sense. The final freedom is to create something or be a part of a creative process. This is the real final choice… to move ahead and undertake actions without any baggage.  The final key is to be true to our self and therein lays our path to Gross Personal Happiness. This book is my way of achieving the gross personal happiness in its highest form. I am certain that while going through the pages, the book will provide all the readers a closeness and a close awareness with their own larger cosmic existence and carry their self to a here-to-before unknown blissful existence.

Understanding of Shrimat Bhagwad Geeta provides that basic substratum at soul level, which is not afflicted even when the greatest of trauma continue to raise their heads around. The Song Celestial continues to apply in every situation. The book produced is a shalok by shalok translation of the great divine expression and is in fact a bare act of Geeta, without any commentary and without any foot notes.

59 years of lateral existence...

It’s a long run since 1955 and a very conscious one since 70’s. The earliest person I know other than my family members is Rear Admiral Dr. Sanatan Kulshreshtha . I know him since I was a little over 3 in 1958 when we shifted to His Highness Flat No.6, Stadium, Jodhpur after abolition of High Court Bench at Jaipur, he with his family in Flat No.9. Incidentally the first message I got this morning at 5.36 am was from him. Life continue to take full circle.

The first flash in my consciousness, of the lateral period of existence, is going to Jaipur jail in 1958 with all the elders, taking breakfast for my father and his colleagues at the Bar, who were detained as they opposed the abolition of Jaipur Bench of High Court of Rajasthan. Yesterday, as I continued to make my submission in the Jalmahal case, it dawned that life and life at bar has amazing multidimensionality as the social dynamics and the nature of beings continued to unveil layer after layer after layer like onion.

In the quantum level of existence it is all quite like a vast fathom deep sea. Some waves somewhere continue to rise and fall, little affecting the nature, content and a rhythmatic beat at which all continue to vibrate on their own by a force working beyond comprehension. For some time now as I see the interplay of multidimensional energies, I stand amazed, awed and bow my head in reverence as I surrender myself to them. It is not difficult to appreciate what and how Arjun would have felt at the time of Vishwaroop darshan of Hari… and that is what I feel every moment of my existence now… dumfounded… consciously blissful...

Towards Economic Independence...

Created and manipulated poverty, by a well-managed economic structure is one of the major reasons for the existence of economic imbalance around the globe. Money is another form of energy and once minted does not disappear, but continues to pass from hand to hand creating debits and credits. As money continues to be exchanged for products or services, a part of it continues to accumulate with those who manage the entire structure through institutions and are well aware of its true nature. This results in the requirement of minting of more money by the Governments.

All the 193 or more countries around the globe continue to mint currencies every day against Government Bonds, with a promise to pay and more with more promise to pay. This money is circulated in the social system through Banks and to Countries through monetary funds and continues to be exchanged ad-infinitum, without destruction. As the amount of money in circulation in the globe continues to increase, it seems that the production in the globe is continuously increasing. In fact what is really happening is that all the Governments are every day increasing their debts and the final credit is going to the fund managers who continue to play successfully in the created global fluctuating market. Currency fluctuations, share market fluctuations and commodities prices fluctuations is a every moment, hour and daily affair. These fluctuations and uncertainties continue to keep people at their wits end but also give them a hopeless hope that one day they will succeed, life will change.

In spite of all possible efforts the laborer in the industry, the man on the street, the trader in the shop, the entrepreneur, bureaucrat and politician in his office is never able to understand the trauma of continued sufferance because of economic dependence on wholly unknown facts, structures and institutional functionality. Those who know are enjoying the traumas, tensions and tribulations.

It is agonizing to see and hear that a man has to struggle for existence, though every human being in this global village is entitled to be provided with the basic human necessities of water, food, clothing, medicine etc. for which there must be no need to work. Every human being is entitled to these basic amenities because he is a human being and nature provides it to all in abundance.

The entire social structure is the multi-fold manifestation of an individual being. The underlying basic structure of every human being, the social system and the cosmos is the same. The true and correct understanding of the basic human system and the principles on which it is functioning, when applied and implemented in the social system has the potentiality to resolve the existing economic imbalance created by a few.

From the moment a cell is formed in our body and classified as a part of a tissue depending on its situational existence, it continues to exist without any struggle. Every cell in the body is provided with oxygen and food through a well networked blood supply system. Every cell in the body is protected at any cost by the whole body system. Any damage or weakening of any cell leads to damage or weakening of the entire body itself. Healthy, energetic and vibrant existence of every cell is imperative for the body to survive and work in harmony.

National Heritage Foundation is working in close co-ordination with Global Political Alliance to provide every human being with Glocal every month. Glocal is a fourth dimension para currency, neither based nor convertible nor exchangeable with any other currency. Glocal is a way to remunerate the people for their un-remunerated work and for the voluntary services provided by them which are not determinable in terms of money.

People globally do great charities, but the same disappear in the existing webbed structures and does not reach the people who are actually contributing to the social dynamics by their mere existence. National Heritage Foundation is working in close co-ordination with several other NGOs which have the same awed objectives and are working together to bring about a more harmonious and peaceful human order.

The time has come to coordinate all heritage like Tao, Hindu, Buddhist, Aborigines in USA, Australia and all over the globe, Zartoshta, Shinto, Pagan, Maori, Maya, Roma and many many others to bring about a new world into existence where every human being continues to survive without struggle for basic human amenities.

Larger Political Conspiracy of UPA to destabilise democracy in India

“UPA, a democratically elected political party entered into a ‘larger political conspiracy’ to file absolutely fake cases based on created facts, false accusations and allegations and used NIA and other investigating agencies to carry on brutal and merciless atrocities against nationalists and created ‘Saffron Terrorism’ out of thin air, with a view to destroy RSS and VHP, world largest NGOs, BJP the political party in opposition and other nationalist organizations, to destroy the world largest democracy and its institutions’.

Background of the ‘Larger Political Conspiracy’

1. Ever since the independence of India in 1947, Global Economic Forces and Multi National Operators have continued to support anti-nationalist activities and similar elements in India to create disharmony, disturbances and divisiveness, so that India is not able to develop into a global power and to lead the people towards peace, harmony and freedom from exploitation. India with its amazing heritage, astounding deep culture and spiritual base is looked up to, by people in almost all countries in the world, particularly with large population of People of Indian Origin (PIO), as the guiding power to help them deal with the issues arising in the new age. It is an accepted global phenomenon that, Indian culture has successfully survived continuous onslaught of almost 947 years (1000 AD to 1947 AD) by foreign invaders as they mercilessly looted and ruled India without a competitor. However, India continued to absorb within itself all those who came and India has never attacked any other country in the entire known recorded history, spanning over 5000 years.

2.With an unparallel and very extensive experience as a nationalist social activist organization, RSS to make serious efforts in resolving the created animosity, between Hindus and Muslims, supported a large number of Muslim and Hindu Youths to form a NGO called the Muslim Rashtriya Manch ('MRM'), to bring Indian Muslim Youth into national mainstream and to promote harmony between Hindus and Muslims in the true sense. MRM has now a following of about 8,04,598 families (signed letter presented to President of India) and has touch based more than 1.5 Crore Muslims in the country, who wish economic empowerment beyond vote bank politics and are now all out in the open to get away with the divisiveness in the society which has been created and perpetrated by pseudo leaders and pseudo politicians. These divisive forces, now and then, by raising controversies and issues like 1947 partition, post Indira Gandhi anti-sikh riots, demolition of Babri Masjid, Godhara, secularism etc. keep charging peoples passions and keep discords and conflicts breathing. These conflicts become sharper when the elections are round the corner. The young generation of Muslims is now fully aware of the created religious divisiveness, which has been used as tool of exploitation and expanding the economic divide.

3. HuJi, Lashkar-e-Tayyeba, SIMI and several other International Terrorist Organizations, banned and interdicted by Government of India and also United Nations Security Council, have continued to advocate and incite Indian Muslim Youth to promote enmity between Hindus and Muslims. They have also by strategically and calculatedly planting and triggering bombs, killed Muslims so that they react, resulting in Hindu Muslim riots and violence. These organizations also have continued to keep tensions brewing between Hindus and Muslims in India. During riots the anti social elements gets a free hand to loot shops, molest women and pick up children all that has disastrous consequences on the common man. All these organizations are internationally funded and supported by Global Economic Forces to propagate poverty. During the period from 08.09.2006 to 26.11.2008, they have been involved in six (6) major terrorist attacks in India– Malegaon 2006 (08.09.2006 and 13.09.2006), Samjhauta Express 2007 (18.02.2007), Hyderabad Mecca Masjid 2007 (18.05.2007), Ajmer 2007 (11.10.2007), Malegaon 2008 (29.09.2008) and Taj Hotel, Mumbai 2008 (26-28.11.2008).

4. This divisiveness of the Indian Society, initiated by Aryan Invasion Theory and Historical Exploitation Theory propounded by the British Raj., has continued to be funded by the Global Economic Forces and fueled by SIMI, HuJI, Lasker-e-Tayyeba etc and also by Naxals, Maoists, Missionaries etc. This discordant on the basis of religion or exploitative statements have all these years suited Congress and now UPA’s 'vote bank' politics as the same has helped them to get into power and retain the same. Polarization of Muslim votes and Muslim appeasement policy by UPA, though the same has not helped the economic growth of the Muslims, Scheduled tribes, Scheduled Castes and other backward classes at all, but has only helped UPA to be in power with about 30 % of vote share.

5.  The conflict ridden policy and continued implementation of divisiveness in Indian Society and allowing corruption, exploitation and appeasement does not in any event allow or entitle a democratically elected political party (UPA) to conspire to destroy other political parties and the cadres supporting them by misusing investigating agencies i.e. ATS, CBI and NIA to falsely implicate innocent nationalists in cases with which they have no links, connections or involvement in any manner whatsoever, either directly, indirectly  or even remotely.

6. In association with these international forces, during 2009 to 2013 UPA Government, particularly the Home Ministers (P. Chidambaram and Sushil K. Shinde) have ruthlessly used Sovereign powers to completely destroy India, the largest democracy in the world. The gross abuse of sovereign power by UPA Government during this period has been more dangerous and disastrous then the period of emergency during 1975 – 1977 and will go down as the another dark age, in the annals of history of India. Some earlier instances of misuse of sovereign power, since independence, that undermined and threatened democracy in India are as follows:

a.  Dissolution of State Assembly and continued Presidents Rule – more than 100 instances since 1950

b.   Imposition of Emergency – 1975 – 1977

c.   Implementation of Mandal Commission Report

d.   Appeasement of Muslims

e.  Weakening of independent Institutions – Election Commission,  RBI, CAG, CBI, NIA, Judiciary etc.

The ‘Larger Political Conspiracy’

1.  Lt. Col. Prasad Shrikant Purohit (‘Lt. Col. Purohit’) belongs to a cultured, middle-class Maharashtrian Brahmin family and is a son of a bank officer. He was born in Pune and got his education from the Abhinav Vidhyalaya and Garware College there.  Neighbours know Lt. Col. Purohit as a soft-spoken man and superiors in the Army remember him as a bright, hard-working recruit. In all conversations with people who knew or had interacted with Lt. Col. Purohit, a common picture drawn is of a zealous young man with a marked patriotic fervour.

2.  In 1994, Lt. Col. Purohit was commissioned into the Maratha Light Infantry after passing out of the Officers' Training Academy at Chennai and served in Jammu and Kashmir for a long period and thereafter was shifted to Military Intelligence. Between 2002 and early 2005, Lt. Col. Purohit was part of a very important counter-terrorism operations in Jammu and Kashmir, MI-25 or the Intelligence Field Security Unit. MI-25 is tasked with looking at the enemy along the Indian border.  Thereafter, Lt. Col. Purohit was posted at Deolali near Nasik in Maharashtra and Panchmani in Madhya Pradesh.

3.   After UPA came into power in 2004 and Malegaon 2006 was executed by SIMI on 08.09.2006 and 13.09.2006, without achieving the desired results, a meeting was held at the Army bases at Deolali and another at Panchmani where Lt. Col Purohit was posted. The meeting was attended by personnel from Ministry of Home Affairs. From the facts and circumstances as has come on record and media, it is evident that Lt. Col. Purohit was given the task to touch base nationalists.

4.  The larger political conspiracy of UPA Government was that the nationalists so identified and touched by Lt. Col. Purohit, with their mobile phone records, could be roped in any of the Terrorists attack which would be triggered independently by some international terrorist group. Recoveries and confessions as we all know are the weapon commonly used to link the criminal with the crime and have always been looked with circumspection by the Courts, but they act as powerful tool to keep investigation and trial going ad infinitem. The conspirators were well aware that that nobody would get convicted in the absence of cogent evidence,  but the whole purpose of the conspiracy was to keep media shouting and breaking news splashing and demean,  degrade and debase nationalists as ‘saffron terrorists’ a word coined by the political conspirators and supporting paid media.

5. It also conspired that after roping and arresting innocent nationalists, they will be ruthlessly tortured by investigating agencies particularly NIA and as they would succumb to pressures, their confessions could be recorded naming RSS, VHP and BJP leaders to make a political kill of the NDA. The powerful trilogy of RSS, VHP and BJP with a large following of committed nationalists which would now include MRM and several other nationalist organizations was making UPA extremely uncomfortable to succeed to get back into power in the elections to be held in March - April 2009. The rising of true India has always been an anathema to pseudo leaders and pseudo politicians, who thrive on perpetration of poverty and exploitation of the masses and the common man.

6. In or about 2007 Lt. Col.  Purohit along with Maj. Upadhyaya formed ‘Abhinav Bharat’ a frontal organization and was given Rs.21,00,000. It is obvious that the people who had created the larger conspiracy had supplied the finances to Lt. Col. Purohit to give confidence to the nationalists about their capacity to act and genuineness as they touch based them.

7. Soon after Malegaon 2008, Lt. Col. Purohit and Major Upadhyaya were arrested. Lt. Col. Purohit gave the name of Sadhvi Pragya Thakur as planned for she was a woman and thought to be a soft and vulnerable target, who would succumb under physical and mental torture. Lt. Col. Purohit was given full assurance that as soon as Sadhvi Pragya Thakur would, as a result of ruthless torture confess the committing of Malegaon 2008 and give the name of  RSS, VHP and BJP leaders, he will be released and in any event he would be given full emoluments, which he is still getting till today while in jail.

8. However, the entire political conspiracy failed because of the unexpected, unforeseen, unanticipated, astonishing and startling resistance and commitment to the nation shown by 37 yrs. old Sadhvi Pragya Thakur.  A name which will be a part of the annals of Indian history, when written correctly. After being in jail for almost 5 years (arrested on 10.10.2008, shown as arrested on 23.10.2008), in a letter written on 17.01.2013 to a Hon’ble Judge of  Bombay High Court, pursuant to an order passed by him,  she wrote:

"5. In spite of being a woman I was encircled by senior police officers and was given beating by belts, thrown on floor, abused using filthy language and was made to hear vulgar CD.
6. (ATS) continued day and night with the aforesaid torture.
7. On October 15,(2008) I don’t know why they took me to Rajdoot  hotel and tortured me. Because of that my membrane of my lung and stomach got ruptured. Since I was unconscious and unable to breath, I was admitted to private hospital Shrusha. The report of hospital mentioned the rupture of membrane. I can place the same as and when directed by you. After keeping me at Shursha hospital for two days, I was shifted to some other big hospital on ventilators and I was kept on ventilators for five days.
8. After slight relief I was again kept in the office room of Mr. Sawant at Kala Chowki and  again subjected to torture.
9. From here I was taken to Nasik at night thereafter my arrest was shown after thirteen days. I had not eaten for so many days and due to their torture I was in unstable state of mind. 
10. In state of unconscious my saffron clothes were removed and a salwar suit was put on. 
11. I was illegally subjected to Narco, polygraph and brain mapping tests without the permission of court. Aforesaid test were again conducted after showing arrest.
12. Lordship, having undergone such inhuman torture, I had developed a serious backbone problems and other problems. I am now unable to walk, sit and stand on my own. 
13. Due to torture by (ATS) I am mentally disturbed and my power to tolerate is also fading away. 
14. Its fifth year since I am and had suffered torture. I was given egg in my food in jail to destroy my ‘Satvikta’. Due to the ill effects of negative environment I am now suffering from serious other diseases. 
15. Now I am suffering from Cancer. I am unable to take diet as prescribed by the doctors. 
16. Due to aforesaid problems, for test and treatment under court orders I had been sent to hospitals at Mumbai and Nasik. They took me to JJ hospital and Government Hospital and Ayurvedic hospital wherein I was admitted under court orders only papers were prepared but no treatment  was offered to me. 
17. In 2009, I had undergone operation of my (Breast). In 2010 again I felt pain. I was in Central Jail, Nasik when MACOCA was dropped. Then I was sent to District hospital as per the orders of court, a special team was constituted which advised for operation. But I was again brought to Mumbai on charges under MACOCA. 
18. Due to critical condition and by court orders I was admitted to J.J hospital Mumbai and Ayurvedic hospital Mumbai. There only formalities were completed no treatment was given. 
19. During my hospitalization, the police security guards due to their police mentality and attitude, despite following all the rules and regulations by me, used to trouble  me for nothing on erroneous ground and the same was reported to Ld. Judge several times. 
20. Since March 2012 I am lodged in Central, Jail, Bhopal, M.P. On deterioration of my condition when I was sent to hospital there also police security guards troubled me the jail authorities wanted to get me treated but security  officers continued with their inhuman attitude and I had to return without treatment due to the same. This had happened to me several times. 
21. Same has been repeatedly going on till now. I wanted to take treatment, I went to hospital but because of the behaviour / attitude of govt. officials, courts and police personals I was afraid to get treatment. Now I am tired of under-going such problems repeatedly for last five years.” 

9.  When Lt. Col. Purohit was not released as expected by him, he spilled the beans and has contended that he has been victimized by military intelligence officials, that he was never involved with Hindu extremists and that he was falsely implicated by a fellow officer, illegally detained and tortured.

10. After 2009, a total of five (5) cases have been marked as acts of ‘Saffron Terrorism’ with the sole political purpose of creating terror amongst nationalists and demeaning and debasing RSS, VHP and BJP. Innocent citizens have been picked up at random and ruthlessly tortured, by the Investigating Agency for no rhyme or reason, particularly by National Investigating Agency (NIA). Ruthless torture and inhumane treatment has continued for almost 5 years now with the sole objective of getting confessional statements of their involvement and the involvement of leaders of RSS, VHP and BJP. The direct and blatant political control, influence and involvement on the investigating agencies is evident by prior statements made by ministers, media leaks and the prosecution acting on such statements. All this is disastrous for a democratic country, where investigating agencies have become active participant in interference with the due process of law.

11.  However, the morale of these innocent nationalists who have been kept in illegal custody and their family is very high.  All these nationalists have been from their childhood days social activists and come from a very humble background with neither having means nor knowledge to undertake these well organised, powerfully economically supported by international organization, highly skilled and professional acts of terrorism, to bring about divisiveness and disharmony between Hindus and Muslims.
